Julia Potter (“We/Us”) is a sole trader with a registered business number (ABN 67 812 134 799) registered in Adelaide, South Australia. We provide Yoga & Pilates instruction, as well as general movement & wellness related information to help you live your best life (“the Services”).

We are committed to providing quality services to you & this Privacy Policy outlines our ongoing obligations to you in respect of how we manage your Personal Data. This policy sets out what kind of information we collect, what we do with it & your choices & rights.

Have have adopted & aim to comply with the following laws: Privacy Act 1988 (Cth, Australia) & the Australian Privacy Principles (APPS); & the General Data Privacy Regulations (‘GDPR’) to provide a high standard to our client’s personal data & privacy (the ‘Data Acts’). The Data Acts govern the way that we collect, use, disclose, store, secure & dispose of your Personal Data.

A data ‘controller’ means the individual or organisation which, alone or jointly with others, determines the purposes & means of the processing of personal data.

A data ‘processor’ means the individual or organisation which processes personal data on behalf of the controller.

We are the controller of any personal data gathered by your use of our website & services. Where we use third parties to process your data we have a contract with these third parties for the provision of these services.

As a provider of wellness/fitness services, we will process the following categories of data:

We may collect information about your visits to us to help us personalise your experience with us. By providing this information to us your are consenting our use in the manner set out in this Policy.

Our primary purpose for collecting & processing this Personal Data about you is to provide & administer our services to you, our clients & marketing. If you object to the collection, sharing & use of your personal data we may be unable to provide you with our services.

We use third party software to securely store your data to perform specific functions to support our services (“third party suppliers”). Third party suppliers have access to personal information needed to perform their functions but may not use it for other purposes. Their privacy policy is linked below as to how they handle data as part of the service we use. With all of the third-party suppliers you can ask us to review your stored data to ensure that it is accurate & best serves you.

Where reasonable & practicable to do so, we will collect your Personal Data only from you. However, in some circumstances we may be provided with information by third parties. We may use third party suppliers for management of specific services eg. payment processing, & they may store some of your Personal Data to provide such service to you. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to use by the third party or that you can access your account to check this information directly yourself.

MARKETING

We may promote our services to you using the information you provide to us via email. If you wish to receive promotional offers, please opt in via this link on our website, on our social media pages or by emailing hello@solspacepilatesmovement.com.au.

If you opt in to receive our emails, you will receive the monthly Sol Space Newsletter featuring wellbeing content, service updates & other related offerings. You can unsubscribe from this at any time from within one of these emails or by contacting us at hello@solspacepilatesmovement.com.au We share your contact information with Squarespace, our email marketing provider, so they can send these emails on our behalf.

If you follow us on any social media platforms, your privacy settings in your social media account control what you share with others. Please be aware that our settings are to ‘Public’ where you leave reviews, comments & we will tag you where appropriate.

This website is hosted by Squarespace. Squarespace collected personal data when you visit this website, including:

Squarespace needs the data to run this website, & to protect & improve its platform & services. Squarespace analyses the data in a de-personalised form.

When your Personal Data is no longer needed for the purposes of which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Data.

DURATION PERIOD

If you have received Services/Products with us we will store your data for 7 years from your last appointment/purchase with us (“Duration Period”), as required by our insurers for any potential claim.

You may have access to this information stored, but this falls under the circumstances where your Right to Request Erasure may be denied. Please see the Information Commissioners Office in Australia guidance on this exception.

YOUR RIGHTS

You have legal rights about your personal data. You grant use of your data under the contract & terms herein through your active conduct & use of our services. At any time you have the right to know what personal data related to you that is held by is, for what purpose, how it is collected & used, with whom it is shared, where it is located, to object to its processing, to have the data corrected if inaccurate, to take copies of the data & to place restrictions on its processing. You can also request the deletion of your personal data.

You may request the following at any time about your data held by us with regards to the services that we provide:

Repeated, unfounded or excessive requests may be challenged by us.

There are some limited circumstances that may limit the information that we can provide to you in a request, for example, public interest, law enforcement, legal & or health related matters.

Please also bear in mind that we rely on third parties for some of your information in the flow of data. It may take us the full calendar month permitted to provide a full response to your request.

INTERNATIONAL TRANSFERS OF PERSONAL DATA

Our services are available internationally (excluding USA, Canada & Brazil). We control & manage Personal Data in Australia. We may transfer data outside of Australia to our suppliers to provide the service to you. If you are European, we transfer your data outside the European Economic Area to fulfil our our services to you as we are based in Australia. We do so to those third-party processors as stated in accordance with this Privacy Policy.

Any third parties used outside of Europe/Australia to help our administration of your data are required to safeguard your personal data through the use of appropriate technical & organisation data security measures & are prohibited from disclosing or sharing your data with other third parties without our prior authorisation, or unless as required by law.

We reserve the right to update & amend this Privacy Policy at any time, effective upon posting an updated version on the Website.
